A notice to creditors tells anyone owed money by the deceased to file a claim before a deadline. Publishing it starts the clock and protects the executor.

Who publishes it: Personal representatives, executors and administrators, usually through their attorney.

Rules by state

  • Florida: the notice to creditors runs once a week for two consecutive weeks. Most claims must be filed within three months after the first publication.
  • California: the Notice of Petition to Administer Estate is published three times before the hearing, in a newspaper of general circulation where the decedent lived.
  • Other states: the statute or the court order sets the number of runs and the claim period.
